These Terms of Service ("Terms") govern your access to and use of the IncentiFind platform and website operated by IncentiFind, Inc. By using our services, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using any part of the IncentiFind platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Services

IncentiFind provides a software platform that aggregates and presents information about green building incentives, rebates, tax credits, and grants available from federal, state, and local programs. Our services include:

  • Free Search — Browse available incentive programs for a property address at no cost
  • Property Report — A detailed, property-specific report of applicable incentives ($25 residential / $500 commercial)
  • IncentiFind Pro — Unlimited searches and advanced tools for professionals ($500/month or $5,000/year)
  • Apply Services — Managed application assistance for a 30% success fee on captured incentives

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at support@incentifind.com.

4. Payments & Refunds

All fees are stated in U.S. dollars and are non-refundable except where required by law. Property Reports are delivered digitally and are non-refundable once generated. Subscription fees for IncentiFind Pro are billed in advance and are non-refundable for the current billing period.

Apply Services fees are success-based: the 30% fee is only charged upon the confirmed capture of an incentive.

5. Accuracy of Incentive Data

IncentiFind strives to maintain accurate and up-to-date incentive information. However, incentive programs are subject to change by the issuing authority at any time. IncentiFind makes no warranty that all incentives listed are currently available or that you will qualify for any specific incentive. Property Reports represent a snapshot in time and should be verified with program administrators before applying.

6. Intellectual Property

All content on the IncentiFind platform, including but not limited to software, data compilations, logos, and text, is the property of IncentiFind, Inc. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

7. Prohibited Uses

You agree not to:

  • Use the platform for any unlawful purpose
  • Scrape, crawl, or systematically extract data from the platform
  • Attempt to gain unauthorized access to any part of the platform
  • Resell or redistribute IncentiFind data without written authorization
  • Upload malicious code or interfere with platform operations

8. Limitation of Liability

To the maximum extent permitted by law, IncentiFind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the platform. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses.

10. Termination

We may suspend or terminate your access to the platform at any time, with or without cause, with or without notice. You may cancel your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Harris County, Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or platform notification. Your continued use of the platform after changes constitutes acceptance of the updated Terms.
